General terms & Conditions of Happy Yoga Time
(one man-business or “eenmanzaak”)

Student- a person, who participates in yoga class/es provided by HYT
Article 1: Classes, duration, freezing and payment
1.1. Single class is a one-time class that has a fixed fee, indicated on the website www.happyyogatime.com. It has to be paid by the student in full amount and no discounts apply for this type of class.
1.2. First-Free class is a single class that is free if followed by a purchase of any of the cards offered or membership. In this scenario the student is to pay only for the card or membership of her/his choice without the cost of a single class. Payment is either refunded or not being charged. No discounts apply for this type of class.
1.3. Happy Guest is a package of 5 yoga classes, offered by HYT on its website and valid for 6 weeks. The student is allowed to choose any classes at any date during this period without restriction. After the expiration date the card isn´t valid anymore. However, 1.4. and 1.5. are applicable. Only one type of discounts may be applied to this card.
1.4. The student has a right to freeze his/her card in case of vacations or injury for no more than 1 week, by notifying HYT via email or personally at least one week before the expiration date of the card.
1.5. HYT has a right to decide about the freezing or denying of any of the cards for longer period than one week by its sole judgment in special cases.
1.6. Happy Bronze is a package of 10 yoga classes that are valid 12 weeks and offered by HYT on its website. Same conditions apply as in 1.4. and 1.5. of this article. Only one type of discounts may be applied to this card.
1.7. Happy Silver is a package of 20 yoga classes, offered by HYT on its website that are valid for 22 weeks. Same conditions apply as in 1.4. and 1.5. of this article. Only one type of discounts may be applied to this card.
1.8. Happy Gold is a membership that gives students the right to attend any of the scheduled yoga classes of HYT on any date and time. The minimum duration of the membership is 6 months. Subscriptions can start at any date of the month. After the initial 6 month period, the membership is automatically prolonged every month. Cancellation is possible by notifying HYT via email or personally one month in advance.
For example, to cancel a membership that has started on January 1st and is valid until 30th of June (6 months), cancelation needs to be received by HYT by the end of May. The payment in June would be the last one we charge and all classes in June can still be attended.
Membership payment is charged automatically and students are obliged to ensure sufficient funds to be charged by HYT from the account provided.
HYT has a right to cancel the membership in case of payment delays. No discounts are applicable for this type of purchase.
1.9. Single private class is a personalized yoga class provided to the student by HYT in the studio or agreed location on an agreed time and date. For locations other than HYT studio €10 extra per class applies for the travel expenses of the teacher. By request, this type of class can be shared by no more than 3 persons. No discounts are applicable for this type of class.
1.10. Private package is a sequence of 5 private yoga classes given to the student by HYT in the studio or agreed location on an agreed time and date. For locations other than HYT studio €10 extra per class applies for the travel expenses of the teacher. By request, this package allows classes shared by no more than 3 persons. All 5 classes have to be scheduled in 10 weeks frame. Freezing of the card is possible according to 1.4. and 1.5. of this article. No discounts are applicable for this type of class.
1.11. All yoga classes, cards and packages of HYT are to be paid in advance in the studio or via online payment.
Article 2: Liability
2.1. HYT is responsible for providing the exact services offered on the website.
2.2. The student is responsible to ensure that his/her personal health is sufficient to participate in the offered classes.
Any concerns or specific medical condition (restrictions) must be communicated to HYT before classes start and participation may only be allowed after consultation of a medical doctor.
2.3. HYT carries out the right to change, add or cancel classes, due to public holidays, likewise by any other circumstance. Such change will be always displayed on he tHYT website and subscribed customers will always be informed via email in case of short notice.
2.4. HYT is entitled to change or to expand house rules, terms and conditions at any time. Such changes will be established at the website of HYT and notified by email to every participant. In case students do not agree to the new house rules, terms and condition, they may end their membership immediately and are entitled to receive payback of any classes not used.
2.5. By signing the intake form and/or participating in yoga class the student agrees with all the conditions and terms provided by HYT.
2.6. HYT is not responsible for any loss or damage of the student`s private belongings as well as for any kind of injury before, during, or after the class.
Article 3: Code of Conduct
3.1. The student is responsible for being respectful to the teacher and other fellow students as well as to the studio rules. No shoes and jackets are allowed in the studio area, except the entry hall/reception. The use of a yoga mat is obligatory. Silence during meditations and respectful attitude during and after classes is required. Private belongings should be stored in the changing room only. Cell phones should be switched off or put to silence mode during yoga classes.
3.2. HYT has a right to exclude the student from the class, as well as to deny future access, in case of inappropriate behavior and/or abuse of the rules, specified above.
Article 4: Applicable Law
4.1. Dutch law applies for all the terms and conditions.
4.2. In case of any dispute may arise between the agreement of the student and HYT it is to be settled by a competent court.
HYT collects personal data of its students strictly for keeping HYT record of the participants, their cards and memberships, managing payment orders and administration.
The data is kept confidential and will not be shared by a third party.
